Overview


The Advanced Seminar is being organised by the University of Maastricht in cooperation with Lexxion Publisher as a part of the project of the Directorate-General for Competition “Training of national judges and judicial cooperation in the field of EU competition law” and is co-funded by the European Union.

The two-day Advanced Seminar covers the following topics:

Session I: Concept of State Aid

  • System of State aid control in the EU
  • Concept of State aid
  • Tutorial: Does a measure fulfill the criteria of Art. 107(1) TFEU

Session II: Role of National Courts and Cooperation with the European Institutions

  • Cooperation between the EC and National Courts
  • Cooperation between EU Courts and National Courts
  • Problem-solving session and round-table discussion

Session III: Dealing with Illegal and/or Incompatible State Aid

  • The role of national courts
  • Tutorial: Recovery of State Aid

Session IV: Special topics regarding the Existence of State Aid

  • The “Altmark” criteria
  • Infrastructure funding
  • Market Economy Investor Principle
  • De minimis aid

 

Methodology

The participants will be actively involved in the seminar.
The sessions will combine presentations, interactive tutorial sessions and discussion on practical problems. You will have ample opportunities to present your own problematic issues and discuss them with the speakers and participants from other Member States.

Just send us your cases and questions in advance! We will forward them to our speakers, who will include your issues in the programme and answer them during the training. All information concerning such problems and cases will be treated confidentially.


Training participants will receive a free copy of Phedon Nicolaides' book 'State Aid Uncovered', a compilation of all State Aid Uncovered articles from 2016.

Who should participate?

The Seminar is free of charge for national judges from all EU Member States.
